By accessing and using the Pickleball Chibi Maker ("Service"), operated by Gensan Pickleballers ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

The Pickleball Chibi Maker is a free, web-based tool that uses artificial intelligence to transform uploaded photos into chibi-style cartoon characters with a pickleball theme. The Service includes:

• AI-powered photo analysis and chibi character generation
• Customization options for hair, outfit, paddle, expression, pose, and background
• Downloadable chibi images with the @GensanPickleballers watermark

3. User Obligations

By using the Service, you agree to:

• Upload only photos you have the right to use. You must own the photo or have explicit permission from the person depicted to upload and process it.
• Not upload illegal, harmful, or inappropriate content. This includes but is not limited to obscene, offensive, defamatory, or infringing material.
• Not attempt to misuse, abuse, or overload the Service. This includes automated scripting, scraping, or making excessive requests to our API endpoints.
• Not remove or alter the watermark on downloaded chibi images without written permission from Gensan Pickleballers.
• Use the Service for lawful purposes only.

4. Intellectual Property

4.1 Generated Chibi Images

Chibi images generated by the Service are created using AI and are provided to you for personal, non-commercial use. You may use your generated chibi for:

• Social media profile pictures and posts
• Personal messaging and stickers
• Team or community branding (non-commercial)
• Personal printing (stickers, merchandise for personal use)

4.2 Watermark

All downloaded chibi images include the @GensanPickleballers watermark. This watermark must remain intact. Removing, obscuring, or modifying the watermark is prohibited without express written consent.

4.3 Service Branding

The Pickleball Chibi Maker name, logo, and branding are the property of Gensan Pickleballers. You may not use our branding in a way that implies endorsement or affiliation without permission.

5. No Account Required

The Service does not require user registration or account creation. There are no usernames, passwords, or user profiles. The Service is completely anonymous and stateless.

6. Availability & Changes

We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice. We do not guarantee that the Service will be available at all times. We are not liable for any downtime, interruptions, or changes to the Service.

7. AI-Generated Content Disclaimer

The chibi images generated by this Service are created by artificial intelligence. Results may vary and are not guaranteed to be a perfect representation of the uploaded photo. AI-generated images are artistic interpretations and should not be considered exact likenesses. We are not responsible for the accuracy, quality, or suitability of generated images.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law:

• We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service.
• We are not responsible for any loss of data, as no data is permanently stored.
• We are not liable for any issues arising from third-party AI services used in the generation process.
• Our total liability shall not exceed $0, as the Service is provided free of charge.

9. Indemnification

You agree to indemnify and hold harmless Gensan Pickleballers, its members, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Third-Party Services

The Service relies on third-party AI providers for photo analysis and image generation. We are not responsible for the performance, availability, or policies of these third-party services. Your use of the Service implies acceptance of the processing of your uploaded photo by these providers.

11. Prohibited Uses

You may not use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity
• Upload photos of individuals without their consent
• Attempt to reverse-engineer, decompile, or hack the Service
• Use the Service for any commercial purpose without written permission
• Interfere with or disrupt the Service or its underlying infrastructure

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in General Santos City, Philippines.
